Health and Safety Documentation
Employment legislation is in place to ensure safety of both employers and employees from unsafe working conditions. To ensure the safety of everyone involved as well as avoiding a lawsuit (a lawsuit could end in fines, coming out of the budget and lowering the money allowed on the production itself), certain precautions must be put in place so as to follow the health and safety act of 1974, to make the appropriate precautions, a risk assessment must be made.
Permission Documentation for Locations
For the locations I am using, I will have to get in touch with the local councils and pay a filming fee, I will be doing this through filmbristol.co.uk.
Release Forms
A talent release form gives the film maker permission to distribute and/or sell their video with the consent of the talent within the video. This is essential in order to prevent any lawsuits from talent that decide they no longer wish to be associated with said video.
Copyright
In the production of film, it is important to gain the permissions/licenses needed for:
broadcast, sets, actors/extras, music, stock film, posters, products/brands, computer programs, dramatic works, props/clothing, books, art and photographs
This is important to avoid any copyright or trade mark issues. For my promotional video I intend to avoid using any of the above that are copyrighted. For the editing software we will be using adobe premier pro which has already had the licence purchased from previous projects. I will avoid using branded clothing so as to not have to acquire any permissions for the use of the brand. For the scene where a character is using a phone, we will use an unbranded, black phone case, with a sticker of the logo of the app on it, so as to only endorse the product we intend to throughout. The music used in the background of the final scene will be just a muffled drum beat to create the effect that it isn't the focus, so this will be taken from a copyright free track off of youtube, however we will still contact the creator of the video to ensure they are okay with our usage of the song for ethical reasons.
Employer/Public Liability Insurance
When shooting on location, public liability insurance is necessary to make sure the producer is covered incase any damages are accidentally made to the location shooting or the accidental injury of members of the public due to shooting.
It is also mandatory for the producer to insure employees against the possibility of any injuries that may happens whilst on set, employers liability insurance is a safe guard for the producer incase an employee has an accidental injury.
Equality Act
The equality act of 2010 is to ensure there is absolutely no discrimination against employees for any reason. This must be taken seriously during the production and everyone must be treated reasonably throughout. Pay for actors will not differ due to disabilities, gender reassignment, pregnancy/maternity, race, religion/belief, sex and or sexual orientation to avoid any kind of discrimination and offence.
Defamation
Defamation is a false, spoken or written communication that once published and visible to the public is harmful to the reputation of a business or individual. Our client (fruit bowl tech) have the power to take legal action if it communicates false information about their brand or product or if they see our product as harmful towards their reputation. The most effective way to prevent the release of possible harmful content or false information is to review the script to ensure no issues with privacy, publicity, copyright, location or any other rights. This is called a Script clearance report. Professional companies can be hired to complete a high standard script clearance report, this can save a large amount of time and allow more time for focus on other sections of the production as well as ensure the report is accurate and professional.
